These Terms and Conditions (the "Terms") form a binding agreement between you
("you" or "User") and OC Global Technology Sdn Bhd ("OCare",
"we", "us", or "our"). They govern your access to and use of the OCare mobile application, the
OCare administration dashboard, the OCare APIs, and any related services (collectively, the
"Service"). By creating an account, downloading the app, or otherwise accessing
the Service, you agree to these Terms, to our
Privacy Policy, and to the
End User Licence Agreement. If you do not agree, do not use the Service.
Important. OCare is a school safety and wellbeing tool. It is not a
replacement for emergency services or for professional mental-health care. In a
life-threatening emergency, contact your local emergency number (in Malaysia: 999) immediately.
1. Acceptance & Eligibility
OCare is intended for use by participating Schools, their authorised staff, parents and
guardians, and students whose accounts are created or approved by the School. By accessing or
using the Service you represent that: (a) you meet the minimum age permitted by applicable law
and your School's policy — generally at least 13 years old, and the higher minimum age set by
your local law where applicable; (b) you are authorised by a participating school or
institution (the "School") to use the Service; and (c) you have the legal
capacity to enter into these Terms, or, where local law requires parental or guardian
authorisation for users below the digital-consent age, the School and/or your parent or
guardian has provided that authorisation before your account was provisioned.
The School is responsible for confirming each student's age and for obtaining and recording any
parent or guardian authorisation required by local law before provisioning access. OCare may
suspend or delete accounts that do not meet these requirements.
If you are using the Service on behalf of a School, you represent that you have authority to
bind that School to these Terms.
2. Accounts & Provisioning
Accounts are provisioned by School administrators. Self-registration is not available for student, parent, teacher, or coordinator roles.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must notify us promptly at [email protected] of any unauthorised use or suspected compromise.
Account sharing, credential reuse, and impersonation are prohibited.
3. Licence to Use the App
Subject to your compliance with these Terms, OCare grants you a limited, non-exclusive,
non-transferable, non-sublicensable, revocable licence to install and use the OCare mobile
application on a device you own or control, solely for the personal, internal, and educational
purpose of using the Service in connection with your School.
You must not:
Copy, modify, translate, or create derivative works of the Service.
Reverse engineer, decompile, or disassemble the Service except where permitted by law.
Sell, sublicense, rent, lease, or otherwise commercialise the Service.
Remove or alter any proprietary notices.
Use automated means (scrapers, bots) to access the Service.
Probe, scan, or test the vulnerability of the Service except via our security disclosure programme.
4. User Responsibilities & Acceptable Use
You agree not to use the Service to:
Post or transmit content that is unlawful, harassing, defamatory, abusive, threatening, hateful, or otherwise harmful.
Bully, intimidate, dox, or stalk any person.
Share pornographic, sexually explicit, or sexually suggestive content, or any content depicting or sexualising a minor (which OCare will preserve, remove immediately on discovery, and report to the National Center for Missing & Exploited Children (NCMEC), the Royal Malaysia Police, and/or other competent authorities, where available, legally required, or appropriate).
Share content promoting self-harm or suicide outside of OCare's support flow, or content that glorifies violence, terrorism, or extremism.
Misrepresent your identity, role, or affiliation with any School.
Upload malware, viruses, or any code intended to disrupt the Service.
Infringe intellectual-property, privacy, or publicity rights of others.
Circumvent security, authentication, or access controls.
Use the Service for advertising, fundraising, or commercial solicitation.
Violate any applicable law or regulation.
Violations may result in content removal, account suspension or termination, and where
appropriate, referral to your School and to law-enforcement authorities.
5. Your Content
5.1 Ownership
You retain all rights you have in the content you submit ("User Content"),
including diary entries, posts, messages, mood check-ins, and attachments.
5.2 Licence to OCare
You grant OCare a worldwide, non-exclusive, royalty-free licence to host, store, reproduce,
transmit, display, adapt, and process your User Content solely to (a) operate, secure, and
improve the Service, (b) run the safety features described in Section 6 and 7, (c) make the
content visible to other users who are entitled to see it under your School's configuration,
and (d) comply with legal obligations. This licence ends when your User Content is deleted in
accordance with the Privacy Policy, except where
retention is required by law or to enforce these Terms.
5.3 Your responsibility
You are solely responsible for your User Content and represent that you have all rights
necessary to grant the licence above. OCare does not endorse, verify, or assume responsibility
for User Content.
5.4 Removal
OCare may remove or restrict User Content that violates these Terms, applicable law, or your
School's policies. Where reasonable and lawful, we will notify the user.
5.5 User-generated content safeguards
OCare operates a zero-tolerance policy for objectionable content
(including pornographic, sexually explicit, child-sexual-abuse, hateful, harassing,
threatening, bullying, and violent content) and for abusive users. OCare cannot pre-screen
every transmission and does not endorse, verify, or vouch for User Content; you alone are
responsible for what you submit. To mitigate harm OCare uses automated and human moderation
to detect, filter, hide, remove, or restrict objectionable, unsafe, or policy-violating
content, and provides the following safety controls, all accessible directly from the app:
Filter mechanism. Automated content moderation runs on diary entries,
posts, and chat messages to detect objectionable material before or shortly after it is
made available to other users. Risk levels (LOW, MEDIUM, HIGH, CRITICAL) are assigned for
human triage; HIGH and CRITICAL items are routed for immediate review.
Report. Every post, chat message, comment, and user profile exposes a
Report control. Reports route to your School's coordinators and to OCare support.
You agree to use it to flag any objectionable content or abusive user.
Block / mute. Users may block or mute other users from chat and feed
surfaces where the feature is available, preventing further contact. School administrators
may also restrict communications between specific users.
24-hour action commitment. OCare will act on confirmed reports of
objectionable User Content within twenty-four (24) hours of confirmation by removing the
offending content and, where appropriate, suspending or ejecting the offending user from
the Service. Reports concerning suspected child sexual exploitation are actioned
immediately upon discovery and reported to NCMEC, the Royal Malaysia Police, and/or other
competent authorities, where available, legally required, or appropriate.
Escalation. Repeated or serious violations may result in content
removal, account suspension or termination, School referral, and law-enforcement
referral.
Identity-linked. OCare does not provide anonymous public posting or
random chat with strangers. Communications are limited to users and roles authorised by
the participating School and are subject to School oversight and moderation.
You acknowledge that the foregoing controls are mitigations, not guarantees. Some
objectionable content may appear before it is detected and removed. OCare's role is to
provide the tools, react promptly to reports, and remove violators — you agree to use the
in-app Report control and not to rely on OCare to anticipate every transmission.
Where permitted by law and School policy, you may appeal a content removal, account
restriction, or AI-related flag by contacting your School administrator or
[email protected]. We may withhold details where disclosure
would create a safety, security, privacy, or legal risk.
6. SOS & Safety Features
The SOS feature is designed for genuine emergencies. False alerts may result in immediate
account suspension and referral to your School or relevant authorities.
OCare is not an emergency service. Do not rely on the Service to summon emergency help. In a
life-threatening emergency, contact 999 (Malaysia) or your local emergency number first.
Delivery of SOS alerts depends on factors outside our control, including network coverage,
device state, and recipient availability.
Schools are responsible for configuring authorised recipients, response procedures, escalation
pathways, and guardian or emergency-contact records. OCare provides software tools to support
communication and triage but does not guarantee that any alert will be received, reviewed, or
escalated within a particular timeframe.
7. AI Moderation & Crisis Resources
OCare runs automated content moderation on diary entries, posts, and chat messages. Details
of models, retention, and human oversight are in the
Privacy Policy, Section 6.
AI verdicts are advisory only and never trigger automated disciplinary action.
Coordinators and OCare administrators review elevated alerts manually.
You may dispute any AI verdict via the "Tell us this is wrong" control on the AI badge.
Crisis resources are shown in-app when an own diary entry is rated CRITICAL.
AI output may route content for human review, but it does not by itself impose account
penalties, disciplinary action, law-enforcement reports, or formal school cases.
AI results may be incomplete, delayed, incorrect, or affected by language, context, sarcasm,
slang, code-switching, or missing information. Risk labels are screening signals for human
triage only and must not be treated as a medical diagnosis, counselling advice, or proof of
misconduct. Schools and authorised reviewers remain responsible for applying professional
judgement, safeguarding procedures, and applicable child-protection obligations. The AI system
is not a medical device and does not replace assessment by a qualified mental-health
professional.
8. Privacy
Our Privacy Policy describes how we collect, use, and share
personal data, and is incorporated into these Terms by reference. By using the Service you
acknowledge that you have read and understood it.
In-app disclosures and permissions
Certain features present additional in-app disclosures or permission prompts before collecting
or using sensitive data, including SOS location, microphone recordings, media uploads, push
notifications, and AI safety analysis of submitted content. If a disclosure or consent prompt
is shown, you must review and accept it before using that feature. You can manage device
permissions through your device settings, but disabling permissions may limit or disable the
related features.
9. Intellectual Property
All software, design, trademarks, logos, and content provided by OCare (excluding User Content)
are the property of OCare or its licensors and are protected by copyright, trademark, and
other laws. "OCare" and the OCare logo are trademarks of OC Global Technology Sdn Bhd No rights
are granted to you in respect of those marks except as expressly stated.
Feedback
If you submit suggestions or feedback, you grant OCare a perpetual, irrevocable, royalty-free
licence to use them without restriction.
Copyright complaints
To report alleged copyright infringement, email
[email protected] with: identification of the work,
identification of the allegedly infringing material, your contact information, a good-faith
statement, an accuracy statement, and your signature.
10. Third-Party Services
The Service relies on third-party providers (push notifications, email delivery, media storage,
hosting) listed in the Privacy Policy. Their terms
and privacy notices govern your interaction with their services. OCare is not responsible for
third-party services, but we use commercially reasonable efforts to select providers with
appropriate security and privacy practices.
You must comply with all applicable third-party terms of agreement when using the Service,
including mobile network, device platform, Apple App Store, Google Play, and any third-party
service terms that apply to features you use.
11. Fees
End users (students, parents, school staff) access the Service free of charge under a licence
held by their School. The commercial agreement between OCare and the School is separate from
these Terms. OCare may offer optional paid features in the future; any such features will be
clearly identified and subject to additional terms.
12. Service Availability & Changes
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance,
unscheduled outages, capacity limits, and dependencies on third-party networks may affect
availability.
We may add, modify, or remove features at any time. We will give reasonable notice of material
changes that materially reduce functionality available to end users.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether
express, implied, or statutory, including warranties of merchantability, fitness for a
particular purpose, non-infringement, and any warranty arising out of course of dealing or
usage of trade.
Without limiting the foregoing, OCare does not warrant that the Service will be uninterrupted,
secure, error-free, or free of harmful components, that defects will be corrected, or that the
Service will meet your requirements. OCare disclaims any liability for actions or inaction by
users, schools, or third parties.
14. Limitation of Liability
To the maximum extent permitted by law, OCare and its officers, directors, employees, and
agents will not be liable for any indirect, incidental, special, consequential, exemplary, or
punitive damages, or any loss of profits, revenues, data, goodwill, or anticipated savings,
arising out of or in connection with the Service, whether based on warranty, contract, tort
(including negligence), statute, or any other legal theory.
OCare's aggregate liability arising out of or relating to these Terms or the Service will not
exceed the greater of (a) the fees paid by the School for the Service in the twelve months
preceding the event giving rise to liability, or (b) one hundred Malaysian Ringgit (RM 100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under
applicable law, including liability for: (a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation; (c) gross negligence or wilful misconduct;
(d) statutory child-safeguarding and child-protection duties; (e) breach of mandatory data
protection or privacy obligations; and (f) any other liability that cannot be excluded by
applicable consumer-protection or safeguarding law in your jurisdiction. The liability cap in
the preceding paragraph does not apply to (a)–(f).
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless OCare and
its affiliates from any claim, liability, damage, loss, and expense (including reasonable
legal fees) arising from (a) your use of the Service, (b) your User Content, (c) your breach
of these Terms, or (d) your violation of any law or third-party right.
For student users who lack legal capacity, this clause applies only to the extent enforceable
under applicable law and any required parent/guardian agreement.
16. Suspension & Termination
We may suspend or terminate your access immediately and without notice if (a) you breach these
Terms, (b) we are required to do so by law, (c) your School directs us to, or (d) continued
access poses a security or safety risk.
You may stop using the Service at any time. You may delete your account from
Settings → Account → Delete Account or via
https://ocare.ocgt.app/delete-account.
Sections that by their nature should survive termination will survive (including 5.2 licence
for retained content, 9, 13, 14, 15, and 19).
Deleting your account may not immediately remove content already reviewed by authorised School
staff, content included in an active safety investigation or safeguarding case, content
preserved for legal-compliance or regulatory reasons, copies retained in backups for a limited
period (≤ 35 days, then overwritten), or content that has been anonymised or de-identified.
Public or group-visible posts may be de-identified or removed in accordance with the
Privacy Policy, Section 10 and your School's policy.
For school-provisioned accounts, deletion requests may be coordinated with or routed to the
School where required by law or School policy.
17. App Store Terms
17.1 Apple App Store
If you obtained the app from the Apple App Store: (a) these Terms are between you and OCare
only, not Apple, and Apple is not responsible for the app or its content; (b) your licence is a
limited, non-transferable licence to use the app on Apple-branded products that you own or
control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and
Conditions; (c) Apple has no obligation whatsoever to provide any maintenance or support
services in relation to the app, and any maintenance and support is OCare's sole
responsibility; (d) in the event of any failure of the app to conform to any applicable
warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app
to you. To the maximum extent permitted by applicable law, Apple has no other warranty
obligation whatsoever with respect to the app, and any other claims, losses, liabilities,
damages, costs or expenses attributable to any failure to conform to any warranty are OCare's
sole responsibility; (e) OCare, not Apple, is responsible for addressing any claims by you or
any third party relating to the app or your possession or use of the app, including
product-liability claims, claims that the app fails to conform to any applicable legal or
regulatory requirement, and claims arising under consumer-protection, privacy, or similar
legislation; (f) in the event of any third-party claim that the app or your possession and use
of the app infringes that third party's intellectual-property rights, OCare, not Apple, will be
solely responsible for the investigation, defence, settlement, and discharge of any such
intellectual-property infringement claim; (g) you represent and warrant that you are not
located in a country subject to a U.S. Government embargo or designated by the U.S. Government
as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of
prohibited or restricted parties; and (h) Apple and its subsidiaries are third-party
beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right
(and will be deemed to have accepted the right) to enforce these Terms against you as a
third-party beneficiary.
17.2 Google Play
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of
Service. To the extent these Terms conflict with the Google Play Terms with respect to your
use of the app obtained from Google Play, the Google Play Terms control.
18. Export Controls & Sanctions
You represent that you are not located in, and are not a national or resident of, any country
subject to comprehensive sanctions by Malaysia, the United States, the European Union, or the
United Nations, and that you are not on any restricted-party list. You will not use, export,
or re-export the Service in violation of applicable export-control and sanctions laws.
19. Governing Law & Disputes
These Terms are governed by the laws of Malaysia, without regard to its conflict-of-laws
rules. The courts of Kuala Lumpur, Malaysia have exclusive jurisdiction over any dispute
arising out of or in connection with these Terms or the Service, except that either party
may seek injunctive relief in any court of competent jurisdiction.
Before initiating formal proceedings, the parties will attempt in good faith to resolve any
dispute by negotiation. Mandatory consumer-protection rights in your jurisdiction are not
affected by this section.
20. General Provisions
Entire agreement. These Terms, together with the Privacy Policy and any agreement between OCare and your School, constitute the entire agreement between you and OCare regarding the Service.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
No waiver. Failure to enforce any provision is not a waiver of future enforcement.
Assignment. You may not assign these Terms without our prior written consent. OCare may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
Changes to these Terms. We may update these Terms from time to time. Material changes will be notified in the app and/or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. Material changes affecting student users may also be notified to the School and/or parent or guardian where required by applicable law or School policy.
School agreement hierarchy. For School administrators and institutional use, the written agreement between OCare and the School controls where it conflicts with these Terms, except for mandatory end-user, platform, privacy, safeguarding, and consumer rights.
